Terms of Service

These Terms of Service (“Agreement”) govern your access to and use of the MKF Collection website (the “Site”) and any purchases made through it. By visiting the Site or purchasing something from us, you agree to be legally bound by this Agreement. If you do not agree, you must not use the Site.
1. Information & Privacy
We may collect information from you when you use the Site. All information will be handled in accordance with our Privacy Policy, which is incorporated by reference into this Agreement. By using the Site, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.
2. Account
To purchase products, you may need to create an account using a username and password. You are responsible for maintaining the confidentiality of your account information and for all activity under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our sole discretion.
3. Intellectual Property & Content
All rights in the Site’s content—including trademarks, designs, text, graphics, and images—are owned by or licensed to MKF Collection. You may use content only for personal, non-commercial use in connection with the Site. Unauthorized use is prohibited.
4. Terms of Sale
a. Orders & Acceptance
All orders are subject to acceptance by MKF Collection. We may reject or cancel any order for any reason, including errors in product information, pricing, or availability. If we cancel an order, you will receive a refund for amounts already paid.
b. Pricing & Payment
Prices are shown in U.S. dollars and are subject to change without notice. We accept major credit cards and other payment methods displayed at checkout. You authorize us to charge your chosen payment method for your order.
c. Shipping & Risk of Loss
We ship within the United States and, where available, internationally. Risk of loss and title transfer to you upon our delivery to the carrier. Estimated shipping times are not guarantees.
d. Sales Tax
You are responsible for applicable sales, use, or other taxes. We collect tax in jurisdictions where legally required.
e. Returns & Refunds
Our return/refund policy is posted on the Site and incorporated into these Terms. Where required by state law (e.g., California, New York, Massachusetts), we conspicuously post our refund policy. If no policy is posted, customers may be entitled to a full cash refund within seven (7) days of purchase, subject to product condition.
5. Third-Party Vendors & Links
We may provide access to third-party vendors, products, or websites. We are not responsible for third-party services, content, or terms. Your dealings with third parties are solely between you and them.

7. Age Restrictions

We may monitor Site use for legitimate business purposes but are not obligated to do so.
9. Warranty Disclaimer
The Site, products, and services are provided “as is” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow disclaimers of implied warranties, so certain limitations may not apply.
10. Limitation of Liability
To the fullest extent permitted by law, MKF Collection is not liable for indirect, incidental, or consequential damages. Our total liability for any claim will not exceed the greater of:
(a) the amount paid by you for the product giving rise to the claim, or
(b) $100.
Some states do not allow limitations on damages, so these limitations may not apply.
11. Indemnification
You agree to indemnify and hold MKF Collection harmless from claims, damages, costs, and expenses arising out of your use of the Site, your violation of this Agreement, or your violation of any law or third-party rights.
12. Dispute Resolution & Governing Law
This Agreement is governed by the laws of the State of New York, without regard to conflict-of-law rules. You agree that disputes will be resolved exclusively in the state or federal courts located in New York County, New York. You waive jury trial rights and any right to participate in a class action, to the extent permitted by law.
13. Revisions
We may update these Terms by posting changes on the Site. Continued use of the Site after changes are posted constitutes acceptance.
14. Severability
If any provision is held invalid, the remainder of this Agreement remains enforceable.
15. Entire Agreement
This Agreement, along with our Privacy Policy and posted Terms of Sale/Return Policy, is the complete agreement between you and MKF Collection and supersedes prior understandings.
